The dynamic of changes in the rules in team games materialize from research and debate between experts and coaches before being implemented by the International Federations. In Handball, the last changes occurred in 2016, and one of them was to substitute the goalkeeper with an additional field player allowing teams to play “empty goal” while using the additional field player.This study aimed to analyze and characterize the use of the 7 vs. 6 strategical-tactical option for the attack in the 2020 (...) Men’s European Championship. We also analyzed whether the game time and partial score influenced the use of 7 vs. 6 and its efficiency. Observational methodology and a mixed ad hoc instrument combining field format and category systems validated by experts were used. Data were taken from 28 matches involving teams in the first 12 positions in the 2020 Men’s European Championship. The total number of offensive sequences in an organized attack method in 7 vs. 6 with an empty goal were analyzed. Sequential analysis techniques with lags, prospective and retrospective, and polar coordinate analysis were used. The results showed that these solutions had poor efficiency, except for the Portuguese National Team; teams using the 7 vs. 6 tactic option had no negative consequences or increased risk with the opponent response; partial score influenced the decision to use 7 vs. 6 strategic option, and game time was associated with 7 vs. 6 play options and detected patterns. Strategies that motivate agrifood producers to adopt more sustainable practices are a critical component for a sustainable future. This case study examines farmer attitudes to a recently released New Zealand agricultural policy aimed at improving freshwater quality by restricting agricultural activities. Our study interprets interviews of nine individuals managing a range of dairy and sheep farming operations to explore how these farmers manage societal expectations of being a ‘good farmer’ in the context of the new regulations. Four themes were developed (...) to capture perceptions of participants: the vested interest of farmers in positive community engagement and being seen as a ‘good’ farmer; the need to manage farms prudently for future generations; the unique geographical and environmental conditions on each farm and their concerns about the lack of acknowledgment of differences across land types in New Zealand; and the unintended consequences of the new regulations for rural communities. Overall, the themes suggest that the way the policy was enacted conflicts with perceptions of a ‘good farmer’ and good farming practice, resulting in identity conflicts for the farming community and reduced motivation to adopt alternative practices. Could age be a valid criterion for rationing? In Just health, Norman Daniels argues that under certain circumstances age rationing is prudent, and therefore a morally permissible strategy to tackle the problem of resource scarcity. Crucial to his argument is the distinction between two problem-settings of intergenerational equity: equity among age groups and equity among birth cohorts. While fairness between age groups can involve unequal benefit treatment in different life stages, fairness between birth cohorts implies enjoying approximate equality in benefit (...) ratios. Although both questions of fairness are distinct, the resolution of the one depends on resolution of the other. In this paper, I investigate whether Daniels’ account of age rationing could be defended as a fair way of setting limits to healthcare entitlements. I will focus on two main points. First, I will consider whether the age group problem could be resolved without appealing to a conception of the good. Second, I will demonstrate that the connection between the age group problem and the birth cohort problem runs deeper than Daniels initially thought—and that it ultimately suggests a method for prioritisation in problem solving strategies. Mitochondrial donation or mitochondrial transfer enables a woman with mitochondrial disease to have a genetically related child without transmitting the disease to the child. The techniques used for mitochondrial donation or transfer which are maternal spindle transfer or pro-nuclei transfer, require three gametes to ultimately produce a healthy embryo. Both these techniques result in the child inheriting nuclear DNA from the intending parents and mitochondrial DNA from the female donor. Following the legalisation of mitochondrial donation in the UK, after a (...) rigorous process of scientific and ethical review, and the birth of another baby using the technique, coupled with the fact that there is no cure for mitochondrial disease, suggests that it is prudent for us to consider this reproductive intervention and its application in the South African setting. In addition, the 2019 UNESCO Report of the International Bioethics Committee (IBC) on assisted reproductive technologies (ART) and parenthood, encourages debate on changes in models of parenthood influenced by ART including the emergence of new models of families and forms of parenthood that extend beyond the classical rule of mater semper certa est (the mother is always known). ART, in particular mitochondrial donation, challenges this rule. The aim of this paper is to provide an outline of the legal and ethical positions of mitochondrial donation and resume the discussion with specific focus on the South African context. (shrink)

Contrary to the ecumenical spirit of our time, the differences among the Christian religions bring into question what one can say or do in common with fellow Christians. This issue, echoing the program of this journal, accentuates those differences, specifically when we focus on the Christian who is ill and suffering. At the bedside, it is the specifics of a religion, including not only its doctrines, but its informing and sustaining narratives, that must particularly be brought into play for the (...) sake of the patient. Given this, our focus in this article regards what such a view implies for the clinician who is caring for a Christian patient whose religion he mayor may not share, in general or in its specifics. Our basic conclusion is that the tendency for the clinician to act as both the patient's spiritual counselor, as well as his clinician, is generally neither prudent nor appropriate. Both hats should not be worn concurrently. This view is advanced not only because of concerns regarding patient vulnerability and the possible abuse of power, but also because the two roles may collide with or undermine each other. (shrink)

Limiting intensive care is paid increasing attention. In the echoing call for physicians’ ethical self‐restriction, it is easily overlooked, however, that ethics needs a critical epistemological analysis before it can suffice as an emergency brake to futile treatment. This analysis is provided by the present essay. The authors suggest that the difficulties of resolving moral dilemmas related to limiting intensive care may just be due to the unclarified epistemological status of moral claims. Even if normative ethics cannot prescribe right decisions, (...) but only draw conclusions from defined premises, the premises may or may not be true. Their intertwined descriptive and normative evidence is endorsed in an academic and political discourse. There will necessarily be various demands for rationality in prudent decisions between physicians, their patients and society. These demands are formulated dialogically through critical questions and justified answers. A good argument is the convincing one that, finally and ideally, leads to the absence of open objections. Thus, in the end the rightness of a given decision does not depend on axiomatic moral principles, but is comparative and conditional, as it is given in an omnilateral argument. Neither is it the democratic process of shared decision making that we should evaluate, but rather the argumentative state itself, when we judge the morality of health politics and clinical practice. Liberal societies are built on a foundation of personal rights, including the right to make decisions about the medical treatment that one will receive or decline to receive. So essential to the liberal project is the power of individual choice that it will be abrogated only in the most extreme situations, in which persons seem to be unable to make rational decisions and thereby to protect their interests. A small number of decision-related abilities have been identified as relevant to the (...) determination of when a person will be deemed decisionally incapable: understanding, appreciation, reasoning, and choice. The relationship between medicine and money is a delicate one that all people involved need to handle responsibly. If one becomes a physician for the mere fact of pursuing money, s/he may soon find that another profession or activity may have fulfilled such a need in a better way. While in the practice of medicine the interest of the patient is paramount, this does not suggest that the welfare of the physician should be neglected at all. It is much about (...) a balance of priorities between the legal and ethical pursuit of money and the promotion of the health of society. Physicians are not called to a life of self-denial, poverty and destitution, as others may be tempted to suggest. The service of patients and the honest reward from one's labour are not incompatible. After all, Aquinas is the most famous medieval thinker in the West, and the question of Church and state is one of the best-known medieval political questions. And yet his thought on that polemical topic remains obscure. As John Watt puts (...) it: "There are too many ambiguities in his doctrine and too many unanswerable questions about what he did or did not hold."1Why is his view not better understood? Part of its obscurity is the relative infrequency with which he writes on politics.2 Another is the relative lack of interest in medieval political thought among political scientists and historians of political thought, an obscurity dating back to the Renaissance.3 Those who do study Aquinas's thought, moreover, have been mired in a controversy over two key texts: one from book II of his Scriptum or commentary on Peter Lombard's Sentences (d. 44, q. 2, a. 3, exp. text.), and the other in book II of De regno (On kingship), chapter 3 (no. 110). For brevity, I will use S for the Scriptum passage and R for the De regno passage.4 These two [End Page 1019] appear to contradict each other, and with respect to fundamental political questions. The debate over these two texts points to what most contributes to the obscurity of Aquinas's teaching on Church and state: confusion about his vision of politics in human life. As I will show in this paper, Aquinas transcends modern categories of the "secular" and "belief" in his treatment of politics. Aquinas valorizes the integrity of political activity: that autonomy is not just a concession to the modern condition. It is in fact when Aquinas is most theological that he is most open to that integrity. The integrity of the political speaks to the intrinsic goodness of that order: it mirrors God's unity in its complex and ordered diversity.In this paper I examine R and S to show their concordance. I argue that they are complementary in what they prescribe for relations between Church and state, and indeed grounded in the same account of the origins of political authority. Through this investigation we will uncover key principles of Aquinas's political thinking that show him to have a capacious vision of politics where humans achieve the actualization of their full beings as human.A key notion will be unitas ordinis, or unity of order: the form of human cooperation in political life. As we will see, that form strikes a middle path between the simple unity of the individual person and the orderless collectivity of a crowd. For Aquinas, that order is itself a common good of politics, and an intrinsic one at that, before any "extrinsic" common good achieved by the people through that order. Aristotle is one of the greatest philosophers who have written on the nature of man. And when he chose to write on man and his pursuit of happiness, he did it by describing carefully the virtues which together constitute the good life. He tells us that moral virtue in general is a habit of choice, essentially consisting in the preservation of the mean, relatively to the persons concerned, as determined by rule, i.e., by the rule by which the prudent man (...) would determine it. In the pursuit of true happiness, then, we must be guided by the prudent man. Hence the importance of prudence in the moral life. For Aristotle, as for St. Thomas, prudence is the auriga virtutum. It deserves careful study, and indeed, it has been studied profoundly by both Philosopher and Theologian. They are in agreement for the most part, but on one point at least they differ greatly. For a better understanding of a virtue Aristotle very often describes the corresponding vice. The contrast of virtue and vice is looked upon as an Aristotelian technique. But there is one vice to which Aristotle devotes no attention: the vice of imprudence. St. Thomas, on the other hand, has no hesitation in treating specifically of the vice of imprudence, its special place and its various parts. (shrink)

The dispute over professional conscientious objection presumes a picture of medicine as a practice governed by rules. This rule-based conception of medical practice is identifiable with John Rawls’s conception of social practices. This conception does not capture the character of medical practice as experienced by practitioners, for whom it is a sensibility or “form of life” rather than rules. Moreover, the sensibility of medical practice as experienced by physicians is at best neutral, and at worst hostile, to the demands of (...) those who would override physician conscientious objection to the provision of currently contested services. That being so, calls for overriding physician conscientious objection are much more demanding of the medical profession than they appear in light of Rawls’s view. As such overriding may entail the forcible transformation of medicine’s form of life, the author contends that it would be more prudent to provide contested services by circumventing the medical profession than by compelling it. The example given is of the effect that self proclaimed HIV dissidents have had on (...) the provision of HIV related public health measures in South Africa. Fundamental to the example given is a distinction that both Schüklenk and indeed the general public often fail to make. It is important to recognise the difference between biomedical science and clinical practice. Science and medicine are two distinct fields, each with their own historically founded methods and purposes; they have had little in common with each other until relatively recently. Biomarkers can be powerful tools to guide diagnosis, treatment, and research. However, prudent use of biomarkers requires formal validation efforts. Although the data needed for biomarker validation has traditionally been hard to access, new research initiatives can ease this process.

This article offers two revisions to Dworkin’s ‘prudent insurance ideal’, which aims to account for justice in the distribution of healthcare so that (a) it can deal with market failures in healthcare and (b) when applied to unjust societies it addresses health problems caused by injustice in a fair manner.

I will focus on Dworkin’s use of idealisation in his “Prudent Insurance” Ideal for healthcare. Dworkin identifies problems with the circumstances under which people make their insurance decisions in the current United States healthcare system and he sees these as being the cause of strange resource allocation outcomes. He therefore imagines idealising away these prima facie unjust circumstances to develop a hypothetical market in which people are able to make better decisions (Section “Idealisation of Circumstance”). I will identify two further (...) idealisations that Dworkin relies on in his theory. The first is to idealise people to be perfectly prudent (Section “Idealisation of Prudence”), which I consider to be justifiable, but difficult to actually apply in practise. The second is to idealise people to be perfectly self-interested (Section “Idealisation to Self-interest”). I do not see this as a justifiable idealization since it ignores principles of altruism and citizenship, which would seem to be deeply relevant to a theory of justice. (shrink)

In their shared works, Gilles Deleuze and Félix Guattari repeatedly advise that ethical practices of experimentation must be imbued with a large dose of prudence. Among commentators, this concept of prudence has primarily been read in cautionary terms, as that which merely enables ethical subjects to avoid the “many dangers” of experimentation. By contrast, this article develops a wider, more positive reading of Deleuzo-Guattarian prudence. Focussing specifically on A Thousand Plateaus, I show that, for Deleuze and Guattari, we must always (...) exercise prudence in ethics because prudence constitutes one positive means of maximizing the success of experimental ethical praxes. This contribution discusses the United Kingdom (UK) government’s regulatory activities related to nanotechnological development. The central question is what other prudent public regulation can learn from the UK government’s regulatory strategy, its regulatory attitude and its large variety of regulatory measures. Other public regulators can learn from the interactive and integrative UK regulatory approach. They can also draw lessons from the critique on the UK government’s regulatory attitude and its problems to cope with specific nanotechnological challenges. These lessons are based (...) on an evaluation of the UK government’s regulatory activities from the viewpoint of prudent regulation. The notion of responsive regulation, which provides basic ideas for the evaluation methodology, refers to a view on prudence that focuses on moral constitutional values. Interestingly, a similar view on prudence has been discussed in nanoethics. (shrink)

Moral intuitionism, which claims that some moral seemings are justification-conferring, has become an increasingly popular account in moral epistemology. Defenses of the position have largely focused on the standard account, according to which the justification-conferring power of a moral seeming is determined by its phenomenal credentials alone. Unfortunately, the standard account is a less plausible version of moral intuitionism because it does not take etiology seriously. In this paper, I provide an outline and defense of a non-standard account of moral (...) intuitionism that I dub the “Prudent Conscience View.” According to this view, phenomenal credentials only partially determine the justification-conferring power of a moral seeming, for a seeming’s justification-conferring power is also determined by its etiology. In brief, a moral seeming is justification-conferring to the degree that the conscience that gave rise to it is functioning properly, and a person's conscience functions properly to the degree that the person is prudent. This article provides Catholic authorities with a useful framework for forming prudent and just policies to minimize clerical child sexual abuse, exploiting the 2011 John Jay College report Causes and Context while not ignoring its shortcomings. The framework is St. Thomas Aquinas’s treatment of prudence, and a “profile” of the clerical perpetrators is developed that uses their narcissism as a middle term to explain why these men behaved the way they did. Much of the discussion surrounding freedom of speech relates to the importance of promoting speech. On this approach, the more speech the better, both for individuals and for democratic society. This line of thought, typically associated with the work of J. S. Mill, has obvious merit. Yet unrestrained speech also poses perils to individuals and society. In this paper, we argue for two theses: (1) Examination of On Liberty shows that Mill in fact supported the notion that forbearance in public (...) speech is ethically justified (albeit not legally enforceable), and (2) Anyone supporting utilitarian principles should give serious consideration to the possibility that prudent forbearance in public speech is a civic virtue. In other words, a reasonable concern for free speech as an integral part of social well-functioning should lead us to temper our manners of expression in circumstances when this is appropriate, and when a policy of complete license in public expression would likely undermine both the well-functioning of the society of which we are a part and the free exchange of ideas that free speech principles were intended to foster in the first place. Adam Smith writes favorably about innovation in Wealth of Nations while writing unfavorably about a figure associated with innovation: the projector. His criticism of projectors prompts many scholars to claim that Smith disapproves of entrepreneurship. But Smith criticizes the projector not because he acts as an entrepreneur but because he fails to meet Smith’s moral standards for entrepreneurship. In Theory of Moral Sentiments, Smith conceives of a framework for moral entrepreneurship based on prudence. The framework consists of two principles: first, (...) approach everyday matters with the general “tenor of conduct” that governs your life and trade, and second, approach life-changing matters with prudence and justice. Recognizing that Smith is concerned with the total effect that an entrepreneurial venture has on society beyond its immediate profits opens the door to engage with contemporary research that studies the ethical and moral externalities of entrepreneurship. Sizemore explicates Niebuhr's Chinese position to provide a skeptical criticism of Reagan's Central American policies.

Most agree that, in some special scenarios, prudence can speak against feeling a fitting emotion. Some go further, arguing that the tension between fittingness and prudence afflicts some emotions in a fairly general way. This paper goes even further: it argues that, when it comes to anxiety, the tension between fittingness and prudence is nearly inescapable. On any plausible theory, an enormous array of possible outcomes are both bad and epistemically uncertain in the right way to ground fitting anxiety. What’s (...) more, the fittingness of an emotion is a demanding, not a permissive, normative status. So the norms of fitting emotion demand a great deal of anxiety. For almost any realistic agent, it would be deeply imprudent to feel anxiety in a way that meets the demands set by norms of fitting emotion. (shrink)

In transplant medicine, the use of normothermic regional perfusion (NRP) in donation after circulatory determination of death raises ethical difficulties. NRP is objectionable because it restores the donor's circulation, thus invalidating a death declaration based on the permanent cessation of circulation. NRP's defenders respond with arguments that are tortuous and factually inaccurate and depend on introducing extraneous concepts into the law. However, results comparable to NRP's—more and higher‐quality organs and more efficient allocation—can be achieved by removing organs from deceased donors (...) and using normothermic machine perfusion (NMP) to support the organs outside the body, without jeopardizing confidence in transplantation's legal and ethical foundations. Given the controversy that NRP generates and the convoluted justifications made for it, we recommend a prudential approach we call “ethical parsimony,” which holds that, in the choice between competing means of achieving a result, the ethically simpler one is to be preferred. This approach makes clear that policy‐makers should favor NMP over NRP. (shrink)

This article conducts a normative evaluation of Operation Iraqi Freedom undertaken in 2003 by employing principles of prudence to enquire whether the use of force could be described as an action by a responsible great power. Along with relating the principles of prudence to the concept of great power responsibility, it highlights two pillars of prudent decision-making: circumspection and awareness of one's limits. This normative framework is then utilised to evaluate the invasion of Iraq from the perspective of these specific (...) aspects of prudence. The conclusion shows that on the basis of this normative yardstick, it is not possible to classify Operation Iraqi Freedom as a prudent action by a responsible great power. (shrink)

L’article établit un contraste entre deux conceptions de la justice distributive (toutes deux libérales et égalitariennes), en vertu de leur attitude respective à l’égard des choix et de la responsabilité. Un premier type de théories établit la distribution des ressources en fonction de la distinction entre choix des agents et circonstances dans lesquelles ces choix s’opèrent : quiconque est responsable en vertu de ses choix de son manque de ressource est considéré avoir renoncé au droit à une compensation. Or cette (...) théorie part d’une conception erronée de la notion de responsabilité. Les considérations légitimes de réciprocité qui la sous-tendent doivent être envisagées dans le contexte d’une doctrine reposant également sur la notion de responsabilité, mais qui part d’une division des responsabilités entre institutions et individus. Cette seconde conception est développée dans le contexte de la distinction établie par Thomas Scanlon entre responsabilité attributive et responsabilité substantielle. Nous demandons ensuite si les principes de justice fondamentaux dont les institutions sont responsables devraient accorder la priorité à l’égalité équitable des chances et concluons en analysant les effets de la remarque de Rawls selon laquelle l’égalité des chances ne peut être réalisée sans abolir la famille. Huemer responds to Michael Young's argument that an ethical egoist should not embrace prudent predation because accepting a principle of prudent predation has serious negative consequences over and above the consequences of individual predatory acts. In addition, he addresses the advantages Young claims for an agent-relative conception of value over an agent-neutral one. He finds that the agent-relative conception does not clearly have any of the advantages Young names, and that some paradigmatic uses of the concept of value are agent-neutral.

The fundamental question of the ethics of belief is "What ought one to believe?" According to the traditional view of evidentialism, the strength of one's beliefs should be proportionate to the evidence. Conventional ways of defending and challenging evidentialism rely on the idea that what one ought to believe is a matter of what it is rational, prudent, ethical, or personally fulfilling to believe. Common to all these approaches is that they look outside of belief itself to determine what one (...) ought to believe. In this book Jonathan Adler offers a strengthened version of evidentialism, arguing that the ethics of belief should be rooted in the concept of belief—that evidentialism is belief's own ethics. A key observation is that it is not merely that one ought not, but that one cannot, believe, for example, that the number of stars is even. The "cannot" represents a conceptual barrier, not just an inability. Therefore belief in defiance of one's evidence (or evidentialism) is impossible. Adler addresses such questions as irrational beliefs, reasonableness, control over beliefs, and whether justifying beliefs requires a foundation. Although he treats the ethics of belief as a central topic in epistemology, his ideas also bear on rationality, argument and pragmatics, philosophy of religion, ethics, and social cognitive psychology. The field of health promotions faces considerable ethical and programmatic challenge – and we believe opportunity – in addressing the relative normativity of the concept(s) of health and its professional handling. To date, distinctions of objective and subjective indicants of “health” have fostered normative tension(s) within the utilitarian ethics of health promotions, which we opine to be anathema to the ultimate goal(s) of attaining and sustaining healthy individuals and societies. Objective and subjective metrics and values should be reconciled, as reciprocal (...) and complementary on both idiosyncratic and systemic levels. In this light, we propose that a philosophical and ethical approach, based primarily upon Schmitz’s New Phenomenology and its specific understanding of subjectivity could afford epistemological bases for non-normative engagement of health promotion within a structural–functional framework of ethics. We dialectically address its potential benefit, limitations and value for health promotion and health care ethics and present an approach which points towards a more substantial encouragement of diversity through the legitimation of subjectivity. When thinking about the intersection of care and Christian bioethics, it is helpful to follow closely the account of Ruth, who turned away from security and walked alongside her grieving mother-in-law to Bethlehem. Remembering Ruth may help one to heed Professor Kaveny?s summoning of Christians to remember ?the Order of Widows? and the church?s historic calling to bring ?the almanahinto its center rather than pushing her to its margins.? Disabled, elderly and terminally ill people often seem, at least implicitly, expendable. (...) By hearing the scriptural account of Jesus? steadfast great-grandmother, readers may recall another way. One may read Ruth?s care for Naomi as a performative, prophetic act of faith. Ruth?s faithful resolve, when set next to Orpah?s prudent way, challenges the notion that a bioethic of care is innately feminine, and may further call women and men corporately to participate in a kind of care that is strenuous work.
